1. Acceptance of Terms

By accessing and using MealPrep Recipes (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

3. Service Description

MealPrep Recipes provides AI-powered meal planning tools, including:

• Personalized TDEE and macro calculations
• AI-generated recipes using OpenAI's GPT technology
• Customizable meal planning with dietary preferences
• Shopping list generation and meal organization
• Instacart integration for convenient grocery shopping
• User authentication via Google, Twitter/X, and Facebook OAuth
• Subscription-based premium features

The Service is provided "as is" and we make no warranties about the nutritional accuracy or suitability of generated content.

4. Health and Nutritional Disclaimer

The Service offers health, fitness, and nutritional information and is designed for educational purposes only. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment.

• Not Medical Advice: Our Service does not provide medical advice. Consult with a physician or other qualified healthcare professional before starting any new diet or fitness program.
• AI-Generated Content: Recipes and meal plans are generated by artificial intelligence and should be reviewed for accuracy and suitability.
• Nutritional Accuracy: We do not guarantee the accuracy of nutritional information or recipe details. Nutritional data is estimated and can vary.
• Allergies: You are responsible for ensuring that any ingredients in the recipes do not cause an allergic reaction or other dietary issues.
• No Guaranteed Results: We make no guarantees concerning the level of success you may experience, and you accept the risk that results will differ for each individual.

5. Subscription and Usage Terms

Free Tier Limitations

• Maximum of 2 saved meal plans
• Maximum of 4 AI recipe generations per month
• Maximum of 4 Shop with Instacart uses per month

Premium Subscription

• Unlimited meal plans, AI generations
• Unlimited Instacart integration use for grocery shopping
• Advanced customization features
• Priority customer support
• Export and sharing capabilities

Payment and Billing

• Subscriptions are billed monthly or annually through Stripe
• Automatic renewal unless cancelled before the billing period
• No refunds for partial billing periods
• Price changes will be communicated 30 days in advance

6. AI-Generated Content and Usage

Our Service uses artificial intelligence to generate recipes and meal plans:

• AI-generated content is for personal use only and may not be redistributed commercially
• We do not guarantee the originality or uniqueness of AI-generated recipes
• Users are responsible for reviewing and validating AI-generated content
• We reserve the right to limit or suspend AI generation for abuse or excessive usage
• AI generation is subject to OpenAI's terms of service and our fair use policies

7. Third-Party Integrations

Instacart Integration

Our Service integrates with Instacart to provide grocery shopping functionality:

• Instacart is a third-party service with its own terms of service and privacy policy
• We are not responsible for Instacart's service availability, pricing, or data practices
• You are responsible for any purchases made through Instacart
• We may share your shopping list data with Instacart to provide the integration service

Authentication Providers

We use third-party authentication services:

• Google OAuth, Twitter/X OAuth, and Facebook OAuth are used for user authentication
• These services have their own terms of service and privacy policies
• We are not responsible for the availability or security of these authentication services
• You may revoke access to your account through these providers at any time

8. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Circumvent usage limits or subscription restrictions
• Use automated tools to generate excessive AI content
• Share account credentials or allow unauthorized access

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of EmpowerCX Consulting LLC and its licensors. AI-generated content is provided for your use but remains subject to our intellectual property rights and OpenAI's terms.

10. User Content and Data

You retain ownership of your personal data and meal preferences. By using our Service, you grant us a limited license to use your data to provide and improve our services. We will not sell your personal data to third parties.

11. Limitation of Liability

In no event shall EmpowerCX Consulting LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service, including but not limited to:

• Inaccurate nutritional information or AI-generated content
• Service interruptions or technical failures
• Data loss or security breaches
• Third-party service failures (OpenAI, Stripe, Instacart, Google, Twitter/X, Facebook, etc.)
• Issues with Instacart integration, pricing, or service availability
• Authentication provider service disruptions or security issues

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including a breach of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and associated data
• No refunds will be provided for unused subscription periods
• Provisions of these Terms that by their nature should survive termination shall remain in effect

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Rhode Island.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use constitutes acceptance of the modified terms. If you disagree with the changes, you must stop using the Service and cancel your subscription.
